29 CFR 1910.30(c)(3): (3) When inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee no longer has the requisite understanding or skill necessary to use equipment or perform the job safely. a) At the job site, located at 1500 4th Street North, Saint Petersburg, FL, on or about November 5, 2022, and at times prior to, the employer exposed employees to fall hazards of approximately 15 feet, in that, employees were observed by the employer not wearing a personal fall arrest system while trimming trees from an aerial lift and the employer did not retrain employees on the recognition of fall hazards and how to reduce or eliminate fall hazards, as well as the correct procedures for installing, inspecting, operating, maintaining, and disassembling the personal fall protection system provided.
