OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, employees were exposed to struck by and crushing hazards on a road construction site: On or about November 21, 2022: An employee engaged in testing soil composition for Geotechnology, Inc. on a road construction site located at W. 201st Terrace and Barkers Street in Spring Hill, Kansas was exposed to struck-by and crushing hazards in that the testing location was in close proximity along the work path of the Caterpillar 12H Motor Grader being operated to grade the road surface. Among other methods, feasible and acceptable methods to correct this hazard would be: 1. Provide employees training on the "Density Testing" Job Hazard Analysis stressing, with emphasis on implementing and using the "Hazard Controls" necessary when working around operational heavy equipment. 2. Require employees to use and complete the "Density Testing" Job Hazard Analysis at every work location, collect the completed JHA to ensure it is being done, and follow up with unannounced field observations to ensure employees use the prescribed "Hazard Controls" for the process. 3. Retrain employees on the necessity, and requirement to wear high visibility clothing on sites where heavy equipment is operated.
