OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing nor likely to cause death or serious physical harm to employees in that employees are exposed to assaults by patients. Employees including Mental Health Associates, nurses, counselors, and physicians were exposed to the hazard of physical threats and assaults, such as being bitten, kicked, punched scratched and sexually assaulted when interacting with patients when providing care, attempting to de-escalate patients, and engaging in daily activities. Assaults have resulted in injuries including scratches, contusions, abrasions, bites, concussions and fractures. a. On or about November 12, 2022, and continuing thereafter, employees, including Mental Health Associates, nurses, counselors, and physicians were exposed to the hazard of physical threats and assaults, such as being bitten, kicked, punched, scratched, and sexually assaulted by patients when providing care, attempting to de-escalate patients, and engaging in daily activities.
