29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s). On or about November 3, 2022, and at times prior thereto, the employer did not ensure taken out of service a forklift that had tires damages including, but not limited to, tires with missing large pieces of rubber (chunks), cracks, and tears, exposing the employee(s) to tip-over, crushed-by, and struck-by hazards.
