Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about October 29, 2022, at the job site located near mile marker 169.4 on southbound interstate 49, the employer exposed employees to the recognized struck by hazard created when an employee operates a motor vehicle while not wearing a seatbelt. On October 28, an Ideker employee was operating a Ford F-650 vehicle equipped with a truck mounted impact attenuator in a mobile construction zone running at approximately 3 miles per hour. The employee was not wearing his seat belt and was seriously injured when another vehicle struck the F-650 from behind. The employee was thrown around within the cabin of the F-650 causing serious injury and his later death. The employer failed to ensure employees operating motor vehicles at slow speed or equipped with an impact attenuator used a seatbelt. Among other methods, feasible and acceptable means of abatement are: 1. Implementing procedures to ensure employees actually wear seatbelts while operating motor vehicles, including taking steps to determine whether seatbelt use is occurring. 2. Adequately training employees in the importance of seatbelt use, even when operating vehicles at low speed and equipped with impact attenuators. 3. Installing equipment such as dash cameras, monitoring software, or other devices that can be used to alert the driver or supervisors when employees are not using seatbelts.
