Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards due to the garbage truck not having a rear loader container latchup mechanism and a hook that did not have a functioning locking mechanism in place: a) Worksite, 235 State St Alley, Hudson, NY 12534 - Dumpster in the Alley - On or about October 24, 2022, a dumpster being lifted by a defective hook was missing the safety lock mechanism exposing an employee to struck-by and crushing hazards. b) Worksite, 2278 State Route 23, Hillsdale, NY 12529 - On or prior to October 25, 2022, garbage trucks did not have rear loader container latchup mechanisms in place exposing employees to struck-by and crushing hazards.
