29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: At a worksite located at or near Mile Marker 169.6 of Interstate 49 heading northbound near Peculiar, Missouri: Workers were exposed to struck-by hazards from motor vehicle traffic. This was demonstrated on or about October 8, 2022, and at times prior to that. Workers were performing work on foot, alone, and using handheld equipment from the rest of the milling and paving operation. Workers were not instructed on how to recognize and avoid potentially unsafe conditions arising from the motoring public; including but not limited to, drivers being distracted, inattentive, experiencing poor visibility, or under the influence of drugs or alcohol.
