Section 5(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) On or about September 15, 2022, at the construction site located on the corner of Lennox Drive & Baltimore Drive in Bismarck, ND employees were exposed to fall hazards while being elevated by and riding on the forks of an all terrain forklift model SkyTrak 8042 to gain access the roof of a house under construction. Among other methods, feasible and acceptable methods of abatement are but not limited to: 1) Ensure that all employees of the company follow both the manufacturers recommendations in the operators manual and follow the ASME/ANSI B56.6 2011 Safety Standard for Rough Terrain Forklift Trucks. 2) Ensure that employees are provided with adequate means for accessing the exterior portions of the home such as but not limited to an extension ladder, aerial lift, approved work platform used in accordance with the forklift manufacturer's instructions. 3) Ensure that all employees involved in the operation are trained and briefed prior to working with this equipment of the hazards involving elevating employees and stability issues involving this piece of equipment.
