29 CFR 1926.704(e): Employees were permitted under precast concrete members while they were being lifted or tilted into position: (a) On or before August 29, 2022, the employer permitted employees to work under precast concrete members while they were being lifted or tilted into position, in that HEI Civil employees were permitted to install sections of 3-foot high, 2,602-pound precast manhole barrels, placing themselves inside the first laid barrel, and having the remaining barrels hoisted above them. This condition exposed employees to crushed-by and struck hazards. (b) On August 29, 2022, the employer permitted employees to work under precast concrete members while they were being lifted or tilted into position, in that HEI Civil employees were permitted to install sections of 3-foot high, 2602-pound precast manhole barrels, placing themselves inside the first laid barrel, and having the remaining barrels hoisted above them. This condition resulted in the fatality of an employee after he was struck in the head by a hoisted precast manhole barrel.
