Text For Citation: 01 Item/Group: 001 Hazard:
29 CFR 1910.146(c)(6):When there were changes in the use or configuration of a non-permit confined space that could increase the hazards to entrants, the employer did not reevaluate that space and, when necessary, reclassify it as a permit-required confined space. (a)On 8/15/2022 and at times earlier, in the Coke Hopper, contractor employees were exposed to falls of up to 13 feet to the bottom of the hopper, and hazardous energy at the point of operation for the vibrator because the employer did not re-evaluate the hopper prior to the work to install a new liner in the hopper, which created new hazards requiring reclassification of the hopper as a permit required confined space.
