29 CFR 1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, was not protected by protective helmets. The employer is failing to protect an employee from overhead struck-by hazards associated with trench work. This was most recently documented on August 9, 2022, at a utility construction site located at the Southwest corner of S 2nd St and S Metcalf Road , Louisburg, Kansas whereby an employee working in a trench measured with a depth of over 6 feet, a width of 3 feet, and a length of over 20 feet was not protected by helmet. Instance of exposure include and not limited to: Employees were exposed to struck-by hazards from spoil piles while working in a trench approximately 6 feet deep.
