29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations: (a)H & W Contracting, L.L.C. at 217 East 6th Avenue, Redfield, SD 57469: On or about and at times prior to August 11, 2022, the employer did not ensure that employees were protected from injury in that the spoils pile on the southwestern wall of the trench was not placed at least two feet from the trench to prevent material from rolling into the excavation. This condition exposed employees to struck-by and cave-in hazards.
