Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and laceration hazards associated with kickback of a Stihl TS-420 cut-off saw during cutting operations: a) On or about August 3, 2022, the employer failed to ensure that an employee was operating a Stihl TS 420 cut-off saw in accordance with the manufacturer's instructions. An employee was cutting an eight inch ductile iron pipe that was not secured and/or supported to prevent the kerf from closing during the cut when a kickback and/or binding of the blade occurred, fatally injuring the employee. b) On or about August 3, 2022, the employer failed to ensure that an employee was operating a Stihl TS 420 cut-off saw in accordance with the manufacturer's instructions. An employee was cutting an eight inch ductile iron pipe with a cut-off saw that was equipped with a blade considered a "rescue blade" when a kickback and/or binding of the blade occurred, fatally injuring the employee.
