OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by an excavator's bucket. On or about 07/27/22, during site work preparation and a sewer line installation for the new Genesee County Jail, located on 3841 West Main Street, in Batavia, New York, the employer did not enforce procedures to provide safe clearances for employees working in a trench and trench box. The excavator operator was allowed to remove soil from an excavated trench while losing sight of an employee in a trench box and exposing them to being struck by the excavator's bucket. ABATEMENT CERTIFICATION REQUIRED
