29 CFR 1926.652(b)(1)(ii) Slopes specified in paragraph (b)(1)(i) of this section, shall be excavated to form configurations that are in accordance with the slopes shown for Type C soil in Appendix B to this subpart. (a) On or about July 28, 2022, at the construction site located near Highland Avenue and Columbia Road in Cedarburg, Wisconsin, an employee was uncovering the water main in an approximately 7.5 foot deep excavation without adequate cave-in protection, thereby exposing the employee to a cave-in and engulfment hazard. Dorner, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1504838, citation number 1, item number 1 and was affirmed as a final order on May 14, 2021, with respect to a workplace located at W186N9581 Bancroft Drive in Menomonee Falls, WI 53051. Dorner, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1415393, citation number 2, item number 1 and was affirmed as a final order on January 24, 2020, with respect to a workplace located at Bridge Street/ 17th Street in Grafton, WI 53024.
