OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and fall hazards: a) On or about June 8, 2022, the employer exposed employees to crushing and fall hazards of approximately 10 feet, in that employees were allowed to ride on the bucket of a Bobcat E60 excavator, resulting in an employee suffering serious injuries when the "clam shell" crushed his leg while riding on the bucket. Among other methods, feasible and acceptable methods to correct the hazards noted is to: 1. Follow the guidelines outlined in the Association of Equipment Manufacturers Safety Manual for Operating and Maintenance- 1991 version on page 21 where it states, "Never use a bucket for a work platform or personnel carrier."
