Text For Citation: 01 Item/Group: 001 Hazard:
Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: (a) On or before June 2, 2022, the employer did not ensure employees were protected from struck-by hazards in that employees were required to ride on the back of a flatbed work truck while it was in motion for the purpose of placement and retrieval of traffic cones and other traffic control devices. This condition exposed employees to struck-by hazards due to falling off the equipment while it was in motion. (b) On May 31, 2022, the employer did not ensure employees were protected from struck-by hazards in that an employee was riding on the back of a flatbed work truck while it was in backing up. The driver of the truck struck a guardrail thus throwing the employee off the bed of the truck onto the ground. This condition exposed employees to struck-by hazards. Feasible and acceptable abatement methods include, but are not limited to: 1) Ensure that employees who place and retrieve traffic cones and other traffic control devices do so safely in a vehicle that is specifically designed for that operation for the purpose of preventing employees from falling off or out of the vehicle while in it is motion. 2) Ensure that employees who place and retrieve traffic cones and other traffic control devices do so safely in a vehicle that has an attachment or modification that is specifically designed for to prevent employees from falling off or out of the vehicle while it is in motion. 3) Utilize truck mounted attenuators on shadow vehicles to assist with protecting employees during work the placement and retrieval of traffic cones and other traffic control devices.
