OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause serious physical harm to employees, in that employees were operating forklifts without utilizing the seat belts present. At the worksite located at 5305 Hwy H, Pleasant Hope, Missouri: Employees were exposed to struck by hazards when operating a forklift in the yard without the use of the installed seatbelt. Employees are engaged in operating Unicarriers Sit down powered industrial trucks in the yard every day. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: (a) Ensure that employees operating a forklift are utilizing a seat belt as required by ASME B56.1-1993. (b) Develop and implement a disciplinary action program and procedures as means of ensuring employees follow safety protocols such as wearing a seat belt while operating these vehicles. (c) Review the company's current forklift training program to ensure it addresses the struck-by, roll over and caught between hazards related to operating a forklift and apply recommended safety measures to ensure safe operation of the vehicle. (d) Have a management official conduct period unannounced forklift inspections while being operated by a certified operator.
