Text For Citation: 01 Item/Group: 001 Hazard:
OSH Act of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire hazards: (a) Shalestone, Inc. 240 Cactus Rose Lane, Rifle, CO 81650: On or before May 18, 2022, the employer did not ensure that employees refueling a booster pump were protected from fire hazards. While the Godwin HL 160M Ori-Prime Booster Pump was running, an employee was in the process of refueling the pump via a hand-held nozzle and hose from a diesel tank. A flash fire occurred which resulted in an employee fatality. This condition exposed the employee to fire hazards. Abatement Note: Among other methods, a feasible and acceptable abatement method to control this hazard is to follow guidance from API 54 Occupational Safety and Health for Oil and Gas Well Drilling and Servicing Operations 5.3.2.1 which states, "[a] risk assessment should be performed prior to refueling and transfer operations. The risk assessment may include but is not limited to: engines running during refueling, grounding and bonding procedures, simultaneous operations, environmental conditions and concerns, and potential ignition sources. Abatement certification and documentation are required for this item.
