OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of being struck-by or caught-in between operating motor vehicles and equipment: a) Linkwood Avenue/S. Clifton Ave., Wilmington, DE 19805: On or about May 5, 2022, employee was exposed to multiple hazards onsite including but not limited to struck-by and caught-in hazards when that employee performed street paving activities in the roadway without a high visibility vest. The employer representative failed to ensure that the high visibility vest was worn on the outer garment, resulting in a high degree of vulnerability for the worker to be struck by or catch in on or near the roadway.
