OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing hazards from falling loads: (a) On or about April 26, 2022 and times prior, at or near 3601 French Street in Bismarck, North Dakota, for the employees engaged in vehicle servicing activities involving automotive lifts who were exposed to crushing hazards created by failing to engage the safety locks, and from hydraulic and/or pneumatic leaks. Note: Among other methods, one feasible and acceptable method of abatement would be to follow the requirements of ANSI/ALI ALOIM which includes, among other requirements, the following: 1. Institute a preventive maintenance program according to the manufacturer's specifications. 2. Provide training to employees on proper use and care of the lifts. 3. Ensure all lifts are rated and marked with their load capacity. 4. Schedule and complete all periodic and annual inspections.
