29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. The employer is failing to protect employees from struck-by hazards. This was most recently documented on or about April 6, 2022, and at times prior to at 9408 Cleveland Ave, Kansas City, MO 64132. The employer failed to inform employees who were operating a pneumatic nail gun at 70 to 120 psi of the hazards. Employees were operating the pneumatic nail gun without wearing impact-resistant eye protection while roofing a residential building. The Hernandez Construction and More LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1464382, citation number 1, item number 1 and was affirmed as a final order on July 13, 2020, with respect to a workplace located at 9968 S Miramar St, Olathe, KS 66061.
