Text For Citation: 01 Item/Group: 001 Hazard:
29 CFR 1910.119(f)(4):The employer did not develop and implement safe work practices to provide for the control of hazards during operations such as lockout/tagout; confined space entry; opening process equipment or piping; and control over entrance into a facility by maintenance, contractor, laboratory, or other support personnel: On or about April 5, 2022 in the MR3 Unit at the Covestro chemical manufacturing complex in Baytown, Texas, workers were exposed to toxic chemical hazards when safe work practices developed by the employer, such as the Site Protective Equipment Policy, were not implemented and workers not in SCBA remained in the unit, working in toxic atmosphere(s). (a)Workers not in self-contained breathing apparatus (SCBA) as required by the employer's safe work policy remained in unit working after toxic atmosphere was detected. (b) The area that could be affected by toxic fumes downwind of process equipment that was being opened, was not cleared of non-essential personnel after it was determined that potential exposure to toxic fumes existed.
