OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to being struck by front-end loader refuse trucks. a) Meadow Lane at Fieldstone Lane, Marlton NJ: On or about 4/7/22, a helper rode on the outside step, at the passenger door, of a front-end loader refuse truck when they were travelling in between collection sites performing collection activities. This step on this truck was not designed, nor built, for this activity. The employee fell off the step and was crushed by the rear wheels of this front-end loader. The employee was not wearing a reflective vest. Among other methods, several feasible and acceptable means of abatement includes, but is not limited to following the guidance in ANSI Z245.1 - 2008, Mobile Wastes and Recyclable Materials Collection, Transportation and Compaction Equipment-- Safety Requirements: Section 6.1.4.1 Monitor the employees activities and take appropriate action to ensure adherence to safe practices and the employee requirements of this standard. 6.1.7.8 Require high visibility apparel as appropriate to the task assigned and the conditions that employees will experience as prescribed in ANSI/ISEA 107-2010, High Visibility Safety Apparel. Section 6.2.3.2 (b) Ride only in a cab except when riding steps are provided, and not anywhere else on the vehicle. Section 6.2.3.2 (d) Remain in driving or riding position (where allowed) during collection activities until the vehicle has come to a complete stop and the brakes applied. Section 9.3.1 Employers shall be responsible for ensuring all employees, including supervisors and contract laborers, are properly trained for their assigned jobs, tasks, and use of the related equipment. Section 9.3.1.1 Training shall be provided at least upon initial assignment to a job or task, with periodic refresher training, as necessary to maintain the required level of competence. Retraining shall be provided for employees whenever there is a change in their job assignments, or a change in equipment that presents a new hazard. Section 9.3.2 The employer shall maintain training records to include dates of training and type of training received. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
