29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. Kaufman and Siebert Households: On or about April 6, 2022, the employees providing direct care for COVID-19 positive residents while wearing N95 respirators did not have a medical evaluation prior to using the respirators. The employer required employees to wear N95 filtering facepiece respirators to protect against the SARS-CoV-2 Virus while providing care to suspected and confirmed positive residents The Jewish Home for the Elderly of Fairfield County Inc, dba Jewish Senior Services was previously cited for a violation of this occupational safety and health standard 1910.134(f)(2), which was contained in OSHA inspection number 1495500, citation number 1, item number 1b and was affirmed as a final order on April 1, 2021, with respect to a workplace located at 4200 Park Avenue in Bridgeport Connecticut.
