OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed-by hazards when utilizing or operating forklifts around unanchored steel storage racking systems. (a) K2D, Inc. dba Colorado Premium Foods at 5120 Race Court, Denver, CO 80216: On and before April 4, 2022, the employer did not ensure that steel storage racking systems in the freezer were bolted to the ground, or secured in another manner to prevent accidental misplacement or collapse while employees used the steel storage racking system, or operated forklifts in the vicinity of the steel storage racking system.
