OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees are constantly walking/working in between the non-anchored pallet racks, thus exposing them to a struck by and/or crush hazard. Location: 270 Marble Avenue Pleasantville, NY 10570 On or about: March 22, 2022 a) Pallet racks were not anchored to the ground, which are approximately 40ft high. Employees are walking/working and driving forklifts between multiple pallets racks daily. Employees are exposed to fall hazards. b) Pallet racks failed to display in one or more conspicuous locations a plaque to permanently and prominently display the permissible loading of the rack. Employees were exposed to fall hazards. c) The employer could not furnish load application and rack configuration drawings with each rack installation. d) Damaged pallet rack uprights and supports were not taken out of service, repaired or replaced before material was stored in them. employees were exposed to fall hazards.
