29 CFR 1926.602(d):The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178. (a) On or about January 18, 2022, and at times prior, an employee operated a Gradall 534D9-45 forklift to lift roofing material to a scaffolding without being trained on forklift operations; exposing employees to struck by and fall hazards. The forklift's back wheels left the ground and the load on the forks hit the scaffolding causing an employee to fall to the ground below. Note: Abatement documentation and certification are required for this item.
