Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they were exposed to vehicular stuck-by hazards. a. On or about March 7, 2022, located at 17312 S. Harlem Ave., Tinley Park, IL, employees were exposed to struck-by hazards while stopping on-coming vehicle traffic in an active roadway. The employer did not ensure safe working conditions at client sites when employees were guiding company's vehicles into roadways. ABATEMENT NOTE: Among other methods, one feasible and acceptable means of abatement would be to; 1. Prohibit employees' entry into live traffic lanes even when vehicles are temporarily absent. 2. Equip work trucks with affixed and/or portable audiovisual devices such as, but not limited to, cameras and presence sensing equipment (e.g. sensors, scanners, etc.) to provide drivers with audible warning and live view (e.g. rear, surround) of their vehicles backing out. 3. Develop truck backing policy to address driver's responsibilities and to assess risk the assisting employees will face in the field. This policy must provide for identifying safe location at each site away from the vehicular traffic where ground employees could still observe it and provide verbal instructions to the driver via telecommunication devices (e.g. two-way radio, telephone, etc.). These workers must wear high-visibility safety apparel that meets and is labeled with the Performance Class 3 ANSI/ISEA 107-2004 in the event of a run-off vehicle. 4. If entry into live traffic lanes is necessary and otherwise unavoidable, follow the relevant requirements of Manual on Uniform Traffic Control Devices (MUTCD) for Streets and Highways for short duration work.
