OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. a) On or about February 28, 2022, an employee mixing mortar on a wood pallet was elevated by a New Holland LS Model Powered 180 Skid Steer approximately 9 feet 4 inches above ground was not protected from falls. Among other methods, one feasible and acceptable means of abatement is to adhere to the manufacturers warning labels and follow the instructions provided in the operator(s) manual and handbook, which prohibits riders on the equipment.
