29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. The employer does not protect each employee from the hazard of falling by the use of fall protection systems. This most recently occurred on February 23, 2022 at the Lot 105 Egret Court, Pickerington, Ohio jobsite. The employer failed to ensure employees were protected from falls while performing framing work from the roof and second story, thereby exposing employees to fall hazards in excess of 20 feet. Luis Enrique Dominguez Martinez was previously cited for a willful violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1487928, citation number 1, item number 1 and was affirmed as a final order on November 3, 2020, with respect to a workplace located at 769 Wharncliff Loop, Pickerington, OH 43147. Luis Dominguez was previously cited for a repeat violation of this Occupational Safety and Health standard 26 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1480742, citation number 1, item number 1 and was affirmed as a final order on July 29, 2020, with respect to a workplace located at 959 Hudson Crossing, Hilliard, OH 43026. Luis Enrique Dominguez Martinez was previously cited for a serious violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1462277, citation number 1, item number 2 and was affirmed as a final order on June 2, 2020, with respect to a workplace located at 1516 Asher Court Lot 660, Marysville, OH 43041. Luis Dominguez was previously cited for a serious violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1441862, citation number 1, item number 5 and was affirmed as a final order on February 21, 2020, with respect to a workplace located at 7094 Scarlet Oak, Hilliard, OH 43026. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards associated with framing construction work activities.
