29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). At the establishment, the employer did not ensure that all employees who operated powered industrial trucks such as but not limited to (Crown C5, model C51000-50, serial number 10146087) were competent to operate them safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l), exposing employees to tip-over, struck-by and crushed-by hazards.
