OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to natural gas/methane fumes: a) Walmart Store #2419, 18922 Rehoboth Mall Boulevard, Rehoboth Beach, DE 19971: On or about 02/09/2022 and days prior to, employees were required to work in the receiving area of the store where a natural gas (odorized) fueled heater was operated while it had a known leak. Management turned the heater on, failed to perform any further leak checks, inspection, or maintenance and operated the heater for approximately 6 hours while employees worked in the area, exposing employees to fire, explosion, and health hazards. Among other methods, some feasible and acceptable method of abatement to correct this hazard is to ensure all managers who are allowed/required to turn on/off the gas to the heating systems be trained to conduct a leak check according to NFPA 54/ANSI Z223.1-2018 paragraph 8.2.3 "Immediately after the gas is turned on into a new system or into a system that has been initially restored after an interruption of service, the piping system shall be checked for leakage. Where leakage is indicated, the gas supply shall be shut off until the necessary repairs have been made." Furthermore, according to NFPA 54/ANSI Z223.1-2018 paragraph 8.2.4 "Appliances and equipment shall not be placed in operation until after the piping system has been checked for leakage in accordance with 8.2.3, the piping system is purged in accordance with section 8.3, and connections to the appliance are checked for leakage."
