OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from crushing/struck-by hazards: (a) On February 8, 2022 and times prior, at or near 300 Mandan Avenue in Mandan, North Dakota, for the employee exposed to crushing/struck-by hazards while conducting lifting operations utilizing an overhead gantry crane where the under the hook lifting devices manufactured in house, were not inspected or tested to determine the weight rating. Note: Among other methods, one feasible and accepted method to correct this hazard would be to follow the requirements contained within ANSI ANSI/ASME B30.20 Below the hook lifting devices; to ensure that all devices attached to the hook of the gantry cranes are fabricated, inspected and tested to determine the devices weight rating.
