OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards. (a)Hajoca Corporation dba McDonald Supply at 5626 West 9th Street, Sioux Falls, SD 57107: On or about and at times prior to January 25, 2022, the employer did not ensure employees were protected from struck-by and crushing hazards in that a corner post of the Frick Gallagher commercial pallet racking near the intersection of aisle 5 and aisle 15 was damaged and was used to support structural members of the pallet racking and stock. This condition exposed employees to struck-by and crushing hazards. (b)Hajoca Corporation dba McDonald Supply at 5626 West 9th Street, Sioux Falls, SD 57107: On or about and at times prior to January 25, 2022, the employer did not ensure employees were protected from struck-by and crushing hazards in that a corner post of the Frick Gallagher commercial pallet racking near the intersection of aisle 5 and aisle 14 was damaged and was used to support structural members of the pallet racking and stock. This condition exposed employees to struck-by and crushing hazards. Among other methods, feasible and acceptable abatement methods to correct this hazard are to follow American National Standard Institute (ANSI) and Rack Manufacturers Institute (RMI)-ANSI-RMI MH 16:1-2012, "Specification for the Design, Testing and Utilization of Industrial Steel Storage Racks." Under paragraph 1.4.1 Owner Maintenance, (2)"Regularly inspect for damage. If damage is found, immediately isolate the affected area. Have a storage rack design professional evaluate the damage and unload, replace or repair if directed by the professional, any damaged columns, beams, or other structural component to restore the system to at least its original design capacity."
