OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from hazards associated with struck by hazards: a. On the North Wall - On or about February 28, 2022, the pallet racks were not anchored in accordance with MH16.1, exposing employees to a caught in and struck by hazard. b. On the North Wall - On or about February 28, 2022, the pallet racks did not have weight ratings in accordance with MH16.1, exposing employees to a caught in and struck by hazard. c. On the North Wall - On or about February 28, 2022, the pallet racks had a damaged vertical upright that had not been reevaluated by an engineer or racking specialist in accordance with MH16.1, exposing employees to a caught in and struck by hazard. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
