OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed-by and struck-by hazards caused by the improper use of automotive lifts: a) Bay 9, Shop Area, 5209 Pittsburgh Road, Uniontown, PA 15401: On or about December 29, 2021, a 10,000-pound capacity Rotary brand automotive lift (model number SPOA10N5G0, serial number: CNP14C0180) used to lift a 2017 Chevrolet pickup truck weighing approximately 8460 pounds (4.23 Tons) was not equipped with the proper adapters. The truck was lifted with round adapters on both rear lift arms. The rear of the truck fell off the lift injuring two employees working below. Also, because the truck bed and tool boxes were locked, employees could not properly assess the center of gravity or total weight of the vehicle prior to lifting. b) Bay 9, Shop Area, 5209 Pittsburgh Road, Uniontown, PA 15401: On or about March 28, 2022, automotive lifts were not maintained in safe operating condition. Multiple instances of pickup truck style adapters with badly worn or completely missing rubber pads were observed on multiple lifts in the shop.
