29 CFR 1926.52(d)(1): In all cases where the sound levels exceeded the values shown in Table D-2 of 29 CFR 1926.52, a continuing, effective hearing conservation program was not administered: (a) On or about 04/13/2022 at 35 Frankfort Street New York, NY 10038 employees sand blasting a steel beam in Arch Block D Span 18 were exposed to an 8-hour TWA of 113.4 dB and 115.5 dB without the employer administering a hearing conservation program including audiometric testing or employee noise monitoring. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.
