29 CFR 1926.1431(a): The use of equipment to hoist employees was not prohibited except where the employer demonstrates that the erection, use, and dismantling of conventional means of reaching the work area, such as a personnel hoist, ladder, stairway, aerial lift, elevating work platform, or scaffold, would be more hazardous, or is not possible because of the projects structural design or worksite conditions: (a) Native Sun Materials Inc. dba Native Sun Construction at 1122 North Albion Street, Denver, CO 80220: On and before December 7, 2021, the employer instructed employees to access and ride a MEVA Climbing Scaffold KLK 230 while the equipment was being hoisted by a Link-Belt HTC-8675, 75-ton Telescoping Boom Crane. This condition exposed employees to struck-by hazards as well as fall hazards ranging from approximately 10 feet to 65 feet. (b) Native Sun Materials Inc. dba Native Sun Construction at 1122 North Albion Street, Denver, CO 80220: On December 7, 2021, the employer instructed employees to access and ride a MEVA Climbing Scaffold KLK 230 while the equipment was being hoisted by a Link-Belt HTC-8675, 75-ton Telescoping Boom Crane. The scaffold system shifted and inverted while it was being hoisted by the crane thus injuring both employees. One employee was seriously injured after he fell approximately 65 feet and contacted the ground. The other employee struck formwork that his fall protection system was attached to. This condition exposed employees to struck-by hazards as well as fall hazards ranging from approximately 10 feet to 65 feet.
