29 CFR 1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. The employer does not protect each employee from struck-by hazards such as potential eye or face injury from flying particles while installing roofing material with air driven nail guns. This most recently occurred on December 2, 2021, during the installation of roofing material at a job site located at 4694 Wyoga Lake Rd, Stow, Ohio 44224; the employer did not ensure employees working on the roof of a single family home were protected from possible danger of eye injury from impact, or from flying objects from the employees installing roofing material with air driven nail guns. To abate this hazard in the future, the employer must ensure employees are provided with, and required to use, eye and face protection in accordance with this standard. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps they are taking to ensure compliance. Ivan Lowky, D.B.A. ILS Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.102(a)(1), which was contained in OSHA Inspection Number 1356354, Citation Number 03, Item Number 01, and was affirmed as a final order on January 7, 2019, with respect to a workplace located at 6595 Brecksville Rd., Independence, Ohio.
