29 CFR 1910.27(a): The employer did not ensure that scaffolds used in general industry meet the requirements in 29 CFR part 1926, subpart L (Scaffolds). 29 CFR 1926.452(w)(6)(ii): The height to base width ratio of the scaffold during movement is two to one or less, unless the scaffold is designed and constructed to meet or exceed nationally recognized stability test requirements such as those listed in paragraph 2.(w) of appendix A to this subpart. a. On November 29, 2021, at the above addressed jobsite, employees conducting maintenance/ repairs of the gym divider curtain approximately twenty-eight (28) feet five (5) inches above the ground from a Genie AWP-25S, were exposed to fall and struck-by hazards. An employee was fatality injured during manual movement of the lift that was not designed and constructed to be ridden during movement, thereby causing the lift to fall over.
