29 CFR 1910.134(d)(3)(i): The employer did not provide a respirator that was adequate to protect the health of the employee under routine and reasonably foreseeable emergency situations: At a worksite located at 2915 Nicholson Ave, Kansas City, MO 64120: Employees were exposed to health hazards in that they may be harmed by the use of a respirator. This was demonstrated on or about November 23, 2021, and at times prior to, when employees and contractors were exposed to respiratory hazards in the form of potentially toxic or hazardous substances during reasonably foreseeable emergency situations. The employer as part of their respiratory protection program failed to evaluate employees' and contractors' exposure to inadvertent mixing of chemicals during pump replacement and did not provide them with proper respiratory protection.
