29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from crushed by hazards by not having operator restraint devices installed on powered industrial equipment: a. 1 Silverline Dr., North Brunswick, NJ - Warehouse The employer did not ensure that employees operating powered industrial equipment used in the movement of materials within the warehouse used operator restraint devices. A mechanic operated forklifts that included, but were not limited to, Komatsu, Model FG25ST-12 forklifts, and did not use seatbelts that were intended to assist the operator in reducing the risk of entrapment of the operator's head and/or torso between the truck and ground in the event of a tip over.
