29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired: a) Kent-Sussex Industries, Inc. at 301 N. Rehoboth Blvd in Milford, DE 19963: On or about November 10, 2021, the employer failed to ensure employees used ladders free of defects. The ladder being used was had a bent rung and side rail but was not removed from service and tagged with "Do Not Use" as required by the standard and exposed employees to fall hazards approximately 14 feet above grade.
