29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): (a)A & B Business, Inc. at 1600 North A Avenue in Sioux Falls, SD 57104: On or about and at times prior to November 3, 2021, the employer did not ensure employees were protected from fall hazards by application of an appropriate fall protection system when elevating and moving plywood on warehouse racking for storage in that one employee stood on top of plywood sheets on the forks of a forklift that were approximately 10 feet above the ground level. One employee fell approximately 10 feet to a concrete floor due as a result of being exposed to this condition. (b)A & B Business, Inc. at 1600 North A Avenue in Sioux Falls, SD 57104: On or about and at times prior to November 3, 2021, the employer did not ensure employees were protected from fall hazards in that an appropriate fall protection system was not utilized when employees would access materials stored on the upper sections of racking by standing on the racking. This condition exposed employees to fall hazards greater than four feet above the concrete floor.
