29 CFR 1910.136(a): General requirements. The employer shall ensure that each affected employee uses protective footwear when working in areas where there is a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, or when the use of protective footwear will protect the affected employee from an electrical hazard, such as a static-discharge or electric-shock hazard, that remains after the employer takes other necessary protective measures. a. On or about October 26, 2021 and days prior, the employer did not ensure that each affected employee used protective footwear when working in areas where there was a danger of foot injuries due to falling or rolling objects. An employee sustained a crush injury when their foot was caught-in between the wheel and concrete floor from the power industrial vehicle similar, but not limited to the Clark, Model ESMII15S, Serial Number ESM247-0474-8717FB.
