29 CFR 1926.1051(a):A stairway or ladder shall be provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided. The employer does not provide a stairway, ladder, ramp, etc., for the personnel points of access where there is a break in the elevation greater than 19 inches. This most recently occurred on October 27, 2021, at a construction site located at 6753 State Road, Parma, Ohio. Employees were exposed to fall hazards of approximately 39 inches while traversing between an upper and lower roof while removing and installing roofing material on a commercial building. To abate this hazard in the future, the employer must ensure employees are provided with a stairway, ladder, ramp, etc., for all points of access where there is a break in elevation greater than 19 inches. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps they are taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards.
