29 CFR 1910.28(b)(15)(iii): Except as provided elsewhere in this section or by other subparts of this part, the employer did ensure each employee on a walking-working surface 4 feet (1.2m) or more above a lower level is protected from falling by a personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems: Location: Warehouse / Storage Facility An employee fell 7 feet to the floor level below and sustained fatal head injuries while working, where fall protection had not been used.
