OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they were exposed to fall hazards from a moving all-terrain vehicle. On or about September 23, 2021, employees were assigned to operate a Type I single-rider 2014 Honda TRX500 Foreman ATV (serial number 1HFTE44D1E4000937) for transportation and towing tasks. The employer did not prevent employees' exposure to fall hazards when riding together as the operator and a passenger. Safe use and operating practices were not followed and the vehicle's suspension parts were unsafely modified. Abatement documentation is required for this item in accordance with the requirements of 29CFR 1903.19(d).
