29 CFR 1926.501(b)(13): The employer did not ensure that each employee engaged in residential roofing activities with unprotected sides and edges (6) feet or more above lower levels, was protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Jobsite: The employer did not ensure that the employee who was working from the roof of the residential building under renovation was protected from fall hazards above six feet by the use of guardrails, safety nets or personal fall arrest systems. On or about August 13, 2021, an employee sustained serious injuries from a fall from at a height above six feet to the ground below. The employer routinely fails to assure effective protection against fall hazard as required by the standard, as demonstrated on or about August 13, 2021, when employees were not protected from fall hazards where fall protection was not worn at the site in front of 660 Williams Street, Bridgeport, CT 06601. To abate this violation, the employer must ensure that affected employees use appropriate fall protection when exposed to fall hazards while working above six feet from a lower level. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance; including an explanation of how these steps protect employees from falling from elevations above six feet that may result in injuries and possible death.
